What probate means for the property

Probate is the court-supervised process of settling a deceased person’s estate. If real estate is part of that estate, and it is not already held in a trust or passed through a beneficiary deed, it typically needs to be sold through the probate process. The surrogate’s court oversees the sale, the executor (sometimes called the administrator) signs the paperwork, and any proceeds are distributed to the heirs according to the will or state intestacy law.

A probate sale is a real estate sale, but with extra documentation, court timelines, and usually more stakeholders than a standard transaction. That is why working with a certified probate real estate specialist matters.
